Documentation from the ongoing Fresenius litigation indicates that more than 80 percent of the more than 2,500 plaintiffs have filed wrongful death lawsuits. Specifically, more than 2,100 plaintiffs have filed individual Fresenius lawsuits against the company alleging that a loved one was killed using one of their products. Fresenius Medical Care manufactures products such as GranuFlo and NaturaLyte. These products are used as part of kidney dialysis treatments. The Fresenius matter has been consolidated into one action, and it is known as a multidistrict litigation, or MDL. The information comes from a census of cases that was filed by Fresenius in December.
A link to that census of Fresenius cases can be found here. Additional information contained in the document includes:
- 2,217 individual Fresenius lawsuits are part of this multidistrict litigation.
- These Fresenius cases involve 2,526 different plaintiffs.
- 2,136 of the 2,526 plaintiffs are claiming that wrongful death occurred as a result of using NaturaLyte and/or GranuFlo.
- The plaintiffs are residents of 47 different states, the District of Columbia and Puerto Rico.
- More than half of the plaintiffs come from Alabama, California, Florida, Louisiana, Mississippi and Texas.
- North Dakota, South Dakota and Wyoming are the only states not represented by at least one plaintiff.
What This All Means
A look at the basic statistics gleaned from the census that the defendant filed shows just how extensive the damage can be when an allegedly defective product hits the market. Thousands of people have been injured and/or killed as a result of using GranuFlo and/or NaturaLyte based on the allegations contained in these individual Fresenius lawsuits. Each of these plaintiffs is seeking different levels of financial recovery for the losses they have incurred. The cases have been consolidated into a multidistrict litigation in order to streamline the process of having these plaintiffs have their cases heard.
About GranuFlo and NaturaLyte Lawsuits
NaturaLyte and GranuFlo are substances used in the course of kidney dialysis treatments. These substances were enormously popular for years. Unfortunately, reports of people suffering from cardiac arrest and other problems began to surface with such a level of frequency that Fresenius seemingly had no choice but to act. As such, the company announced a GranuFlo and NaturaLyte recall in 2012. Many of these Fresenius lawsuits date back to before the recall.
Some investigations indicated that the reason that so many people using these products were suffering from sudden heart problems and even death was because of the bicarbonate levels associated with GranuFlo and NaturaLyte. When bicarbonate levels are too high, it can put the heart in a situation of immediate and extreme risk. This circumstance means that people who were using these products should have been monitored closely after dialysis treatments.
If you or someone you love has suffered as a result of either of these products, you need to seek the help of the Fresenius lawsuit attorneys at Parilman & Associates as soon as possible. You can either email the firm or call 800-800-DRUG.
