Nursing Home Negligence Leads to Wrongful Death in Michigan

Posted by Personal Injury Lawyers on Wednesday, 28 December 2011 in Law Blog

Many Nursing Home complaints have been filed across the U.S. concerning negligent care and abuse.  In 2010, a resident in a Michigan nursing home choked to death on her own tracheostomy tube. The nursing home is being sued by the family of Alicia Cegers against the Borgess Gardens nursing home in Kalamazoo.

Cegers tracheostomy tube was entangled in her bed rail when she was strangled to death. The family refused to cash the $100 check that was issued to them for the negligent cause of death.  This is the standard fine issued to families of relatives that have suffered such negligent care in Michigan. The Ceger family refused to cash the check.

The Borgess nursing home have been designated by the U.S. Centers for Medicare and Medicaid as a Special Focus Facility.  This facility has been ranked amongst the worst nursing homes in the state for patient care.

Ceger’s care plan required two caregivers to care for her. At the time of her death there was only one caregiver. She suffered from multiple breathing tube problems which the lawsuit claims was caused by poor care. Doctors made notations requiring specific attention to her tracheostomy tube. The recommendations were not followed by the care facility.

Many nursing homes across the nation have had complaints filed against them for similar negligence.
